Terms of Service.
Dropkick.fm is a launch platform for independent music, run by Murfin Ltd, a company registered in the United Kingdom. These terms explain what you can expect from us and what we expect from you. By using Dropkick.fm you agree to them.
1. About these terms
"Dropkick", "we" and "us" mean Murfin Ltd. "You" means anyone using the site, whether you're listening, upvoting or submitting music. How we handle personal data is covered separately in our Privacy Policy.
You must be at least 13 to create an account. If you're under 18, check with a parent or guardian first.
2. Your account
You sign in with a link sent to your email address. Keep access to that inbox secure: anyone who can read it can sign in as you. One person, one account. Listener accounts are private; artist profiles are public pages you create separately from your account.
3. Artists and your music
- You confirm you own or control the rights to the music you submit, or have permission from everyone who does, and that the SoundCloud or Bandcamp profile you connect is yours.
- You keep all rights to your music. You give us a non-exclusive, worldwide, royalty-free permission to show your profile, track titles, artwork, descriptions and the official player on Dropkick and in links shared from it, so listeners can discover your work. This ends when you remove the content, except for copies already shared by others or kept in backups for a short time.
- We don't host audio. Tracks play through the official players of the platform where you published them, or link out to it.
- Verification shows you controlled the connected profile when we checked. It isn't an identity or copyright check.
- We review profiles and tracks before they appear and can decline them without giving detailed reasons.
- During pre-launch you can submit up to three tracks. After launch, each artist can launch one track every seven days.
4. Founding Artists
The first 100 approved artists receive a numbered Founding Artist badge. It's free, has no cash value and can't be transferred or sold. We can remove a badge obtained through impersonation, false information or fraud, and give that number to someone else.
5. Upvotes and charts
- Charts are built from upvotes by signed-in listeners: one upvote per account per track.
- Buying, selling, trading or automating upvotes, using several accounts, or asking others to do so is not allowed. We remove upvotes we believe are manipulated and may suspend the accounts involved.
- Payment never changes a chart position. Sponsored placements are labelled and kept out of the charts.
- Chart results are final once a chart period closes, but we can correct them if we find manipulation or an error.
6. Artist email subscriptions
Listeners can subscribe to an individual artist. Once a subscriber confirms by email, that artist can download their address. Artists must only use those addresses to send their own news, must include a working unsubscribe link in every email, and must stop emailing anyone who unsubscribes. Artists are responsible for their own emails.
7. Paid promotion
Promotion is optional. It buys a labelled Sponsored placement for a set number of impressions and doesn't guarantee plays, upvotes, subscribers or chart positions. Campaigns are reviewed before they start. If we decline a campaign, or can't deliver it, we refund the unused part. Payments are processed by Stripe. Your rights under consumer law are not affected.
8. What you must not do
- Submit music you don't have the rights to, or pretend to be another artist.
- Post anything unlawful, hateful, harassing, sexually explicit involving minors, or that infringes someone else's rights.
- Scrape the site, overload it, probe it for weaknesses or get around its limits.
- Use Dropkick to send spam or to collect other people's data.
9. Reporting and removing content
If something on Dropkick infringes your rights or breaks these terms, tell us through Report a problem or at hello@dropkick.fm. We can remove content, reset upvotes or suspend accounts that break these terms, and we'll usually tell you why.
10. Other platforms
Players and links from SoundCloud, Bandcamp and other services are provided by those services under their own terms. We're not responsible for their content or availability.
11. Our responsibility to you
We work hard to keep Dropkick running and accurate, but we provide it as it is and can't promise it will always be available or error free. We're not responsible for losses that weren't foreseeable, for business losses, or for anything caused by other platforms. Nothing in these terms limits liability that can't legally be limited, including for death or personal injury caused by negligence, or for fraud.
12. Ending your account
You can delete your listener account from your account page and request deletion of an artist profile from your dashboard settings. We can suspend or close accounts that seriously or repeatedly break these terms.
13. Changes and contact
We may update these terms as Dropkick grows. If a change matters, we'll tell you on the site or by email before it applies. These terms are governed by the law of England and Wales, and the courts of England and Wales can hear any dispute, though you may also be able to bring a claim where you live.
